By using the WinSmart Order App, you agree with our User Terms of Service (“Terms of Service”). Please read our Terms of Service carefully before using the WinSmart Order Service.

1. Definitions

These terms of Service (“Agreement”) set forth the general terms and conditions of your use of the “WinSmart Order” mobile application (“Mobile Application” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Win Solution AS (“Win Solution AS”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity.

If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the WinSmart Order App and Services. By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Win Solution AS, even though it is electronic and is not physically signed by you, and it governs your use of the Mobile Application and Services.

2. Description of the WinSmart Order Service

2.1. WinSmart Order provides a mobile platform so the User can order and purchase products from the selected restaurant, shop, or others, which is referred to here as “Partner”. Each partner has detailed privacy policy and term of services, which show also clearly in the WinSmart Order App to the User.

2.2. The Partner provides their products and maybe certain services, i.e., name, ingredient, allergens, and price per unit. If you would like to have questions relating to the products and allergens, please contact the relevant Partner. The Partner has responsibility for updating prices and legally required details of the products.

2.3. When User selects the products and services of the Partner, the Partner can demand payment for the item from the time it is sent from the Partner to the User. If the User uses a credit card/debit card or Vipps when paying, the seller can reserve the purchase price on the card when ordering. The card will be charged when ordering. The Partner is responsible or liable towards the User for the proper execution of the Purchase Agreement

2.4. Order tracking: Once the order is completed and payment has been accepted, the User can also track or check the order directly in the WinSmart Order App.

2.5. In connection with the order, User agrees that we store and use your information. We do this to fulfill our obligations to you. We process personal data according to the Personal Data Act. We also document all communication we have with you via e-mail, in order to offer the service that you expect from us.

2.6 Accuracy of information: Occasionally there may be information in the WinSmart Order App that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers. The Partner reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the app or Services is inaccurate.

2.7.Cancellation: As a customer, the User has the right to cancel the order. If the User wants to cancel the order, you must contact Partner directly by phone, and you must do so within a reasonable time after you have ordered.

3. Accounts and membership

If you create an account in the Winsmart Order App, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may, but have no obligation to, monitor and review new accounts before you may sign in and start using the Services.

You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

4. Links to other resources

The WinSmart Order and Services may link to other resources (such as websites, mobile applications, etc.), please carefully review the legal statements and other conditions of use of any resource which you access. Your linking to any other off-site resources is at your own responsibility.

5. Disclaimer of warranty

You agree that such Service is provided on an “as is” and “as available” basis. We try our best to fulfill our obligations to you, but we make no warranty that the Services will meet all your requirements.

6. Changes and amendments

We reserve the right to modify these terms related to the WinSmart Order App and Services at any time at our discretion. When we do, we will revise the updated date at the bottom of this page.

An updated version of this Agreement will be effective immediately upon the posting of the revised Agreement unless otherwise specified. Your continued use of the WinSmart Order App and Services after the effective date of the revised Agreement (or such other act specified at that time) will constitute your consent to those changes.

7. Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By accessing and using the WinSmart Order App and Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Mobile Application and Services.
